Consent to the Collection, Processing, and Storage of Personal Data

In accordance with the Law of the Republic of Kazakhstan “On Personal Data and Their Protection” and other regulatory legal acts of the Republic of Kazakhstan,
I hereby, acting freely, of my own will and in my own interest, give informed consent, for the purposes of registration and use of the computer software “MICA”, to the collection and processing of personal data, by means not contrary to the legislation of the Republic of Kazakhstan, by Limited Liability Partnership “MICA” (Business Identification Number 250640030539, registered at the address: Republic of Kazakhstan, Karaganda Region, Karaganda, 100012, 48 Abai St., office 1), hereinafter referred to as the “Operator”.
This consent is given for the collection, recording, systematization, accumulation, storage, clarification (updating, modification), use, retrieval, transfer (provision, access), depersonalization, blocking, deletion, destruction, cross-border transfer, as well as any other actions with personal data, taking into account the applicable legislation of the Republic of Kazakhstan, in respect of my personal data for the following purposes:

• provision of access to the computer software “MICA” and related services;
• performance of the Operator’s obligations towards the User;
• carrying out communications aimed at improving the quality of services provided;
• sending notifications, informational and advertising messages about new products and services;
• compliance with the requirements of the legislation of the Republic of Kazakhstan;
• for the Operator’s internal control and accounting;
• for judicial and extrajudicial protection of the Operator’s rights: in case of breach of obligations; in case of disputes, including disputes with third parties.

Personal data processed by the Operator:

• full name;
• telephone number;
• email address.

Other data processed by the Operator:

• history of actions in the personal account;
• access to the Company’s/Contact Person’s CRM system;
• list of employees;
• sales funnels;
• transaction data.

Consent is given for the entire period of my use of the computer software “MICA”, as well as for the period of data storage established by the legislation of the Republic of Kazakhstan after termination of the use of the Service.
I confirm that:

1. this consent extends to all relations with the Operator, including those already existing and/or arising at the time of granting this consent, as well as to any others that will arise in the future, and is valid both during the period of my (the Data Subject’s) legal relations with the Operator and after their termination for the periods established by the legislation of the Republic of Kazakhstan, necessary for the proper exercise by the Operator of the rights and obligations imposed on it by the legislation of the Republic of Kazakhstan;
2. by this consent, the Operator is granted the right to independently determine the conditions for access of Third Parties to personal data;
3. when the Operator collects, processes and carries out cross-border transfer of personal data, no notification of the Data Subject is required;
4. this consent may be provided to Third Parties as evidence that the Operator has the necessary authority to collect, process and carry out cross-border transfer of the Data Subject’s personal data;

this consent may be revoked in cases regulated by the legislation of the Republic of Kazakhstan, on the basis of an appropriate application, by sending a letter by email.

Privacy and Personal Data Processing Policy

This Privacy and Personal Data Processing Policy (hereinafter – the “Policy”) governs the procedure for processing and using personal and other data obtained by Limited Liability Partnership “MICA” (hereinafter – the “Operator”) in the course of providing a paid right to use the computer software “MICA”, developed within the framework of activities for the creation, implementation, maintenance and development of artificial intelligence technologies.

By transferring personal and other data to the Operator via the Website, the User expresses full and unconditional consent to the terms of this Policy. If the User does not agree with the terms, they must cease using the Website and the Operator’s services.
Unconditional acceptance (acceptance) of this Policy is the User’s actual use of the Website.

1. TERMS
1.1. Website — the website located on the Internet at https://4sell.ai/. All exclusive rights to the Website and its elements belong to the Operator. The exclusive rights are not transferred to the User.
1.2. User — a person using the Website or obtaining access to the Operator’s services.
1.3. Legislation — the applicable legislation of the Republic of Kazakhstan.
1.4. Personal Data — the User’s personal data which the User provides independently upon registration or in the course of using the functionality of the Website, and which allow their identity to be identified.
1.5. Data — other data about the User (not falling under the concept of Personal Data).
1.6. Registration — completion by the User of the Registration Form located on the Website by indicating the required information and sending scanned documents.
1.7. Registration Form — the form located on the Website which the User must complete in order to be able to use the Website in full.
1.8. Service(s) — the provision of a paid right to use the computer software “MICA” and other related services.

2. COLLECTION AND PROCESSING OF PERSONAL DATA
2.1. The Operator collects and stores only those Personal Data that are necessary for the Operator to provide the Services and interact with the User.
2.2. Personal Data may be used for the following purposes:
2.2.1. provision of Services to the User;
2.2.2. identification of the User;
2.2.3. interaction with the User;
2.2.4. sending the User advertising materials, information and requests;
2.2.5. conducting statistical and other research;
2.3. The Operator, inter alia, processes the following data:
2.3.1. full name of the Contact Person;
2.3.2. contact telephone number;
2.3.3. access to the Company’s/Contact Person’s CRM system;
2.3.4. list of employees;
2.3.5. email address;
2.3.6. sales funnels;
2.3.7. transaction data;
2.4. The User undertakes to provide reliable Personal Data and not to place data of third parties without the relevant authorization.

3. PROCEDURE FOR PROCESSING PERSONAL AND OTHER DATA
3.1. The Operator undertakes to use Personal Data in accordance with the Law of the Republic of Kazakhstan “On Personal Data and Their Protection” and the internal documents of the Operator.
3.2. Personal Data and other Data of the User are kept confidential, except in cases where such data are publicly available.
3.3. The Operator has the right to keep an archival copy of the Personal Data.
The Operator has the right to store Personal Data and Data on servers outside the territory of the Republic of Kazakhstan.
3.4. The Operator has the right to transfer the User’s Personal Data and Data without the User’s consent to the following persons:
3.4.1. state authorities, including inquiry and investigation bodies, and local self-government bodies upon their reasoned request;
3.4.2. in other cases directly provided for by the applicable legislation of the Republic of Kazakhstan.
3.5. The Operator has the right to transfer Personal Data and Data to third parties not specified in Clause 3.4 of this Privacy Policy in the following cases:
3.5.1. the User has expressed their consent to such actions;
3.5.2. the transfer is necessary within the framework of the User’s use of the Website or the provision of Services to the User;
3.6. The Operator carries out automated processing of Personal Data and Data.

4. PROTECTION OF PERSONAL DATA
4.1. The Operator provides appropriate protection of Personal and other data in accordance with the Legislation and takes necessary and sufficient organizational and technical measures to protect Personal Data.
4.2. The protection measures applied include, inter alia, protection of Personal Data from unlawful or accidental access, destruction, alteration, blocking, copying, dissemination, as well as from other unlawful actions in relation to them by third parties.

5. MISCELLANEOUS
5.1. The law of the Republic of Kazakhstan shall apply to this Privacy Policy and to the relations between the User and the Operator arising in connection with the application of the Privacy Policy.
5.2. All possible disputes arising out of this Agreement shall be resolved in accordance with the applicable legislation at the place of registration of the Operator.
Before applying to a court, the User must comply with the mandatory pre-trial (claim) procedure and send the Operator a corresponding written claim. The period for responding to the claim is 30 (thirty) business days.
5.3. If for any reason one or more provisions of the Privacy Policy are found to be invalid or unenforceable, this shall not affect the validity or enforceability of the remaining provisions of the Privacy Policy.
5.4. The Operator has the right at any time to amend the Privacy Policy (in whole or in part) unilaterally without prior agreement with the User. All amendments shall enter into force from the moment they are posted on the Website.
5.5. The User undertakes to independently monitor changes to the Privacy Policy by reviewing the current version.
5.6. All suggestions or questions regarding this Privacy Policy shall be communicated by email to support@4sell.ai or by phone at +7 (706) 696-91-11.

6. CONSENT TO PERSONAL DATA PROCESSING
6.1. By accepting the terms of this Policy, the User expresses their consent to the collection, storage, processing and transfer of their personal data to the Operator for the purposes provided for in this Policy.
6.2. Consent is granted for the period of use of the Website and the Operator’s Services, as well as for the subsequent data retention period established by the legislation of the Republic of Kazakhstan.

2. executed in written form, which is delivered to the Operator at least 30 (thirty) calendar days prior to the date of revocation of this consent, or delivered in person at the Operator’s address. At the same time, I (the Data Subject) am aware that, in accordance with the Law, this consent cannot be revoked in cases where such revocation would contradict the Law, or where I (the Data Subject) have outstanding obligations to the Operator or Third Parties; in particular, due to the requirements of the legislation of the Republic of Kazakhstan, revocation of consent applies to the collection, processing, storage and transfer of my personal data from the moment of such revocation and does not affect data collected, processed and stored by the Operator before the moment of such revocation and within 3 (three) years from the date of full termination of my (the Data Subject’s) relations with the Operator. I (the Data Subject) am aware that revocation of consent to the collection, processing, storage and transfer of my personal data may entail the impossibility of receiving services from the Operator, and I understand that, in the event of such revocation, the Operator is released from any liability towards me for non-provision / incomplete / untimely provision of services by the Operator from the moment of such revocation;
3. I shall have no claims against the Operator in respect of the collection, processing and cross-border transfer of my personal data in the future, subject to the Operator’s compliance with the requirements of the Law and/or the conditions agreed in this consent;
4. receipt of the Operator’s services from the moment I am informed of the need to provide such Consent constitutes my full and unconditional acceptance of the conditions provided for in this Consent;
5. consent to the conditions provided for in this document, expressed in electronic form, is equivalent to consent provided by me (the Data Subject) on paper;
6. in case of disagreement with the conditions of this statement of consent to the collection, processing, storage and transfer, including cross-border transfer, of my personal data, I shall be solely responsible for refusal to use the Operator’s Service and to receive services from the Operator.

The text of this consent has been fully read by me; I have no additions, comments or objections.

The date of granting this consent to the collection, processing and storage of the User’s personal data is the date of sending the registration form on the “MICA” Service. Consent to the collection and processing of personal data is deemed to have been granted to Limited Liability Partnership “MICA” from the moment the User clicks the “Register” button (or a similar registration confirmation button) placed on the registration form on the website https://4sell.ai/.
